Mathias - the phrase is "giving aid and comfort to the enemy". Which she did, without question. Not even John Walker Lindh was accused by the attorneys of doing that while he fought with weapon in hand against US forces. The phrase ’giving aid and comfort to the enemy’ seems to be pointed only to enemy forces/agents inside the USA, not outside the USA. At least when I understand the FBI definition in the actions against possible sleeper cells inside the USA correctly.

I ain't getting sucked into that argument again. We started it about 5-8 years ago and you still won't accept any assessment but your own (which was formed while walking backwards through much of RVN) I can say the same about you. But at least you know when to give up when you're wrong.

Article III, Section 3 of the US constitution "only in levying war against them, or in adhering to their enemies, giving aid and comfort to them" Does not limit itself to enemy forces inside the USA. In fact Enemy forces inside the USA could not be considered as traitors to the US but as enemy combatants. A traitor is one who aids an enemy against his/her own country.

Would going to Canada to avoid the draft be considered treason or excersising free speech . Not treason, because it would be hard to stretch it to giving aid and comfort to the enemy by not engaging (Unless, like Don, you are so feared by the enemy that you not being there gives him courage to continue to fight)

If not treason then what , one wonders who died taking the place of the cowards , Jimbo Carter should not / no ever given those people amnesty , Jimbo Carter should not / no allow Iran hold this Country hostage over 55 hostages , Reagan told Iran they better settle the issue before he was sworn in , a word to the wise can work wonders .

As I remember, one could be jailed for avoiding the draft back in those days. I'm not that up on its provisions to say it would apply in cases of folks who went to Canada before their number came up. Where is a lawyer when you need one?
