California, like Canada, has a cap on how much a patient can sue for emotional damages, and, for the Golden State, it's about $250,000.00. Now the tort lawyers want to raise that, so as to make it easier to sue. I'm all for caps, but I agree with the lawyers on this one, because medical malpractice is very difficult to do, especially since the doctors' lawyers are known for fighting every inch. So, to make it worthwhile to represent the patients, lawyers must be given a greater incentive.
